?Wikileaks did not pay Bradley Manning? ? military lawyer: Voice of ...

Military lawyer Philip D. Cave commented on the case for the Voice of Russia.?

Voice of Russia: Let?s review the story before we begin to analyze it: Private Manning is accused of delivering these documents to WikiLeaks, which subsequently published it. Do we know the value of these documents and the danger that their release represents, or is that ultimately irrelevant, because a classified document is a classified document??

Philip D. Cave: It was said in the beginning that there were some names of people who cooperated with Americans in Iraq. Their names have been disclosed, so it has put them in danger. And the other point you make is that there are people who care that it?s something that damages national security.?

VOR: When it originally broke, the government said that most of it was very old data. Even if it hadn?t been declassified and it wasn?t a threat, have we got any idea from Freedom of Information Act releases or other information that this is the case ? or was the material still sensitive??

PC: There is still a lack of transparency, and certainly people are looking at it, but from a public perspective. I don?t think we are going to know; I don?t think they are going to let us know until some time in the future.?

VOR: Manning said he released these documents out of a sense of duty, isn?t that right? It wasn?t an issue of money or spying in the traditional sense.?

PC: Some people said he was angry at the military because he was being discharged and he wasn?t treated very well, and it was some sort of revenge. I don?t know if anybody has come forward and said he got paid for it.?

VOR: His lawyers are now saying he was treated to illegal pretrial treatment involving the violation of the Constitutional Right against Cruel and Unusual Punishment. What does his lawyer say that was he subjected to??

PC: He?s been subjected to some very irregular procedures, which most people may agree are unnecessary and severe. In 2011 he was transferred to a medium security facility and the way he is treated has changed.?

VOR: What state physically and psychologically do we believe Manning is in right now??

PC: At the moment he seems to be okay and the reason I say this is that the pretrial proceedings are ongoing, and he has acted on proceedings and there haven?t been issues where he was complaining. So it?s quite possible that in the different facility he is being treated much better. I suspect his conditions right now are good enough that he is able to appear at this trial.?

The defense is requesting the court to dismiss all charges with prejudice owing to the illegal pretrial punishment Manning was subjected to in violation of Article 13 of the Uniform Code of Military Justice, and the Fifth and Eighth Amendments to the United States Constitution. The case, which is being heard at a military tribunal in Fort Meade, will continue until October 1.
